The 9th U.S. Circuit Court of Appeals ruled today that Proposition 8, the 2008 ballot initiative that codified the traditional definition of marriage, is invalid and unconstitutional. The ruling is not the end of the road for Proposition 8, it is headed for the US Supreme Court. Never before has a federal appeals court – or any federal court for that matter – found a fundamental right to gay marriage under the U.S. Constitution.
